Terms of Service
Last updated: ⬜ [date]
1. Who these terms are with
Gatherer is operated by ⬜ [legal entity, or "Vithu Namasivayam, operating as Gatherer"] in Montréal, Québec, Canada ("we"). These terms apply when you use Gatherer. By using it, you agree to them. If you do not agree, do not use Gatherer.
2. What Gatherer is
Gatherer is a free website that shows what is in restaurant meals. It has two parts:
- Chain calculators. They use the nutrition information that restaurant chains publish about their own menus.
- Restaurant and dish pages. They show entries added by contributors, who submit the numbers from their own tracker for dishes they ate. Each entry says how its numbers were measured, and every entry is shown separately.
3. How accurate the numbers are
We do not measure or verify the numbers on Gatherer. An entry is only as accurate as the contributor's tracker and method, and a chain's information is only as accurate and current as what the chain published. Portions and recipes change. You decide which numbers to trust.
Gatherer's numbers are information, not medical, nutritional or dietary advice. Do not rely on them for any decision where a wrong number could harm you, including managing a medical condition, an allergy or an intolerance.
ALLERGIES: Gatherer does not provide allergen information and must never be used to avoid an allergen. Always check with the restaurant.
4. Adding a dish
- Anyone can add a dish entry for any restaurant. You do not need a password.
- Every entry needs an email address. We send a sign-in link to that address to confirm the entry, and you can use the same address later to sign in and manage your entries. Keep access to your email secure: anyone who can open your sign-in links can manage your entries.
- You must be at least ⬜ [age] to add an entry.
- Your email address is never published. Your entries are public, and they show a display name only if you choose to show one.
5. What you submit
- When you submit an entry, you confirm that the numbers are your own: they come from your own tracking of a dish you ate, and the measurement method you select is the one you used.
- You keep ownership of what you submit.
- You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example, translate or reformat), publish and display your entries on Gatherer, including your display name if you choose to show it, to let visitors view them and copy them into their own tracker, and to have our service providers do so on our behalf. ⬜ [How long the licence lasts once you delete an entry.]
- You can delete your entries or stop showing your display name at any time by signing in with your email address.
- Do not include other people's personal information in an entry or a display name.
6. What you may not do
When you use Gatherer, you may not do the following. We may remove any entry, or stop accepting entries from an email address, that breaks these rules.
- Submit numbers that are not your own, or a measurement method you did not use.
- Use a display name that impersonates someone, or that is offensive or misleading.
- Scrape, bulk-download or systematically extract Gatherer's data, or resell it.
- Overload, disrupt or reverse-engineer the service, or get around its limits.
- Use Gatherer for anything unlawful.
7. Restaurants and chains named on Gatherer
Restaurant names, trademarks and menu items belong to their owners. Gatherer is independent and is not endorsed by, affiliated with or sponsored by any restaurant or chain named on it.
We name businesses to say what the nutrition information is about. Chain calculators use nutrition facts the chain has published, which may have changed since we last updated them.
A restaurant can write to ⬜ [email] to correct or dispute information about its food.
8. No warranties
Gatherer is free and provided "as is" and "as available". To the extent the law allows, we do not promise that it will always be available or free of errors, or that its numbers are accurate or complete. We may change or discontinue any part of it.
9. Limitation of liability
To the extent the law allows, we are not liable for any loss that results from relying on numbers published on Gatherer, including numbers submitted by contributors or published by chains.
⬜ [This clause needs professional review before these terms take effect.] Nothing in these terms limits any right you have under Québec's Consumer Protection Act or any other law that cannot be waived by contract.
10. Changes to these terms
We will post any change here and update the date at the top. If a change is significant, we will give notice on this page before it takes effect.
11. Governing law
These terms are governed by the laws of Québec and the federal laws of Canada that apply there. Disputes go to the competent courts of Québec, subject to any right the law gives you to bring a claim elsewhere.
12. Language
These terms are available in French and English. ⬜ [Which version prevails if they differ.]
